This is the 21st article in the “SEP Declaration and Standard Mapping Database” series. As of September 2026, the core logic of HRPP’s undeclared SEP mining and assessment services is as follows:

  • Core fact: Undeclared SEPs exist not only in the communications field, but also in existing national standards (GB, industry standards, group standards) and international standards (ISO, IEC, ITU, 3GPP, IEEE). Based on the parts-based methodology, HRPP can provide mining and assessment services for undeclared SEPs in these standards to member enterprises, helping them take the initiative in standard licensing, standards layout, and defensive negotiations.

I. Background: Undeclared SEPs Exist Not Only in Communications Standards

II. Four Types of Undeclared SEPs in National and International Standards

Type One: First declared in national standards, undeclared in international standards.
Some Chinese enterprises disclose patents in national standards in accordance with the “Provisions on the Administration of Patents Involved in National Standards,” but the same technical solution is not declared in international standards (ISO, IEC, ITU). This puts Chinese enterprises in a passive position in international standard licensing.

Type Two: Declared in international standards, not marked in national standards.
Some international standards (such as 3GPP and IEEE) have SEP declaration databases, but when Chinese national standards or industry standards adopt them through transformation, related patents are not marked simultaneously. When enterprises implement national standards in the Chinese market, they may overlook SEP licensing obligations.

Type Three: Standards organizations have no declaration mechanism.
The patent declaration mechanisms of ISO, IEC, ITU, and other organizations are not transparent, and some standards have no corresponding SEP declaration database at all. Even if enterprises want to declare, they do not know how to do so.

Type Four: Enterprises are unaware or strategically do not declare.
Enterprises own patents covering a standard, but because they do not participate in standards development, internal departments operate in silos, terminology is mismatched, or they make a strategic choice, they never declare to any standards organization.

IV. How the Parts-Based Methodology Conducts Mining and Assessment

Step 1: Standard Part identification.
Conduct parts-based decomposition of the target national or international standard, identifying Standard Parts, Core Parts, Improvement Parts, and Decorative Parts. Priority is given to interfaces, protocols, and data formats at the Standard Part tier.

Step 2: Standard document mapping.
Map Standard Parts to standard documents one by one to determine whether the standard “normatively requires” (shall) implementation of the technical solution.

Step 3: Patent reverse search.
Use the technical features of Standard Parts as search criteria to conduct reverse searches in patent databases. Do not limit to “SEP declaration” status; cover Chinese enterprises, international enterprises, NPEs, and SMEs.

Step 4: Essentiality grading.
Grade the patents found through reverse search by parts tier:

  • Core Part → medium essentiality;

  • Decorative Part → generally not essential.

Step 5: Report delivery.
Form an “undeclared SEP list” marking:
